When a property suffers damage, the path to getting it repaired almost always runs through an insurance claim — and that path is rarely as straightforward as homeowners and condo boards expect. Florida has consistently ranked among the most challenging states in the country for property insurance, with rising premiums, tightening coverage, and increasingly scrutinized claims becoming the norm rather than the exception.

When a claim is filed, the insurance company doesn’t simply take the policyholder’s word for the damage. They retain their own Professional Engineer to inspect the property, determine whether the cause of damage is actually covered under the policy, and calculate the dollar value of any payout — assuming their assessment supports coverage at all. When a property damage claim is filed, most policyholders assume their insurance company will fully and fairly compensate them for covered damages. Unfortunately, recent industry data tells a different story — and Florida homeowners face the steepest odds in the nation.

A 2024 analysis by Weiss Ratings, based on data insurers file with the National Association of Insurance Commissioners (NAIC), found that Floridians filing a homeowners insurance claim had the lowest chance of any state in the country of getting paid in 2022, with more than a third of claims going unpaid [3]. The following year, two of the state’s largest insurers — subsidiaries of State Farm and Allstate — closed nearly half of their claims without any payment at all [3]. These findings were independently corroborated by NAIC’s own state-level claims data, which confirmed Florida insurers denied the highest percentage of claims of any state and had the largest share of unprocessed claims nationwide [3].

The pattern isn’t unique to Florida. Nationally, almost 40% of homeowners insurance claims are denied for various reasons [2], and the nation’s 13 largest homeowners insurers denied 47.5% of their claims in 2023 alone, compared to a 37.4% denial rate across all reporting underwriters [1].

Why do so many claims get denied? According to the Insurance Information Institute, the most common reasons include damage that falls outside the policy’s covered perils — such as flood, or in some policies, wind — missing or insufficient documentation, damage below the deductible, missed filing deadlines, and disputes over whether damage is from a covered event or ordinary wear and tear [2].

For property owners, this means that receiving a denial or a low settlement offer does not necessarily mean the claim lacks merit — it often means the case for coverage wasn’t made strongly enough. Insurance companies and policyholders frequently disagree on the cause of damage, scope of repairs, code upgrade requirements, matching issues, depreciation calculations, and repair costs.

Many homeowners, condominium associations, and commercial property owners face a significant disadvantage during the claims process because insurance carriers typically rely on experienced adjusters, engineers, consultants, and contractors to evaluate damages. Property owners often do not have access to the same technical expertise.
